Superior Council of Prosecutors meeting: Request for recusal of the General Prosecutor. Stioanoglo regrets that an anti-corruption prosecutor did not comply with the request to leave the system

The Prosecutor General has repeatedly acknowledged that he has asked anti-corruption prosecutors to leave the system, expressing regrets that some have not complied with his request. The statements of the head of the General Prosecutor’s Office were made during today’s meeting of the Superior Council of Prosecutors (SCP).

In the meeting of Thursday, March 11, 2021 the Superior Council of Prosecutors examined the appeal against the decision of the College of Discipline and Ethics of the Superior Council of Prosecutors. Prior to the examination, according to the procedure, the anti-corruption prosecutor Vladislav Bobrov submitted a request for recusal of one member of the Superior Council of Prosecutors, namely the General Prosecutor Alexandr Stoianoglo, on the grounds that he had publicly exposed the anti-corruption prosecutor’s request.

General Prosecutor Alexandr Stoianoglo spoke publicly during the SCP meeting in 2019 that there is incompatibility between my activity prosecutor, before at least any disciplinary procedure or service control was initiated against me. The same position regarding my activity Mr. Alexandr Stoianoglo later said in at least two interviews given to www.NewsMaker.md. In this order of ideas, I consider it is well-founded that the Prosecutor General, Mr. Alexandr Stoianoglo has a preconceived opinion about my work and in such circumstances, he will not be able to be objective in examining the appeal filed by me. ” said anti-corruption prosecutor Vladislav Bobrov.

In this context, the member of the CSP, the president of the Bar Association Emanuil Ploșnița, asked Bobrov to present evidence confirming the arguments for the recusal request.

In return, SCP member Alexandr Stoianoglo confirmed at the meeting that he had asked, including Bobrov, to leave the system, reiterating his regret that he had not submitted his resignation request and is still a prosecutor.

Dear colleagues, it is true that a year ago, in the totalization of the activity of the Anticorruption Prosecutor’s Office, we demanded the resignation of several prosecutors, including the prosecutor Mr. Bobrov. Unfortunately, unlike other colleagues, he did not apply for dismissal and remained in the prosecutor’s office. These requests were made on the basis of the control that was made by the General Prosecutor’s Office within the Anticorruption Prosecutor’s Office and then I already knew about the preliminary results. I do not know Mr. Bobrov, I did not work with him, but my request was related to his activity and following the control performed by the General Prosecutor’s Office, Stoianoglo declared during the CSP meeting.

Subsequently, the members of the SCP entered into resolutions, only to postpone the examination of the appeal.

The application for recusal filed by Mr Bobrov is resumed and the examination of the appeal against the decision of the College of Discipline and Ethics of 23 December 2020 is postponed. Mr Bobrov, has time, until the next hearing to present evidence in support of the request for recusal which has been submitted.

We specify that according to NM at one of the meetings with the employees of the prosecutor’s office from all over the country, Alexandru Stoianoglo requested that the prosecutors from the Anticorruption Prosecutor’s Office Andrei Băieșu, Vladislav Bobrov, Mihail Ivanov and Roman Statnîi resign voluntarily. Thus, in a comment for NM, the general prosecutor Alexandru Stoianoglo confirmed the fact that he asked the prosecutors to resign. He specified that he does not know any of them personally, he does not have any settlements with them, but the results of the verifications performed at the specialized prosecutor’s offices proved to be “incompatible with their further activity”.
