This is the position of the interim president of PAS, Igor Grosu, expressed following the PAS detached victory in the early parliamentary elections of July 11 this year. Being invited in a TV show, the interim president of PAS, Igor Grosu criticized harshly the activity of the General Prosecutor’s Office, led by Alexandr Stoianoglo.

We had very high expectations from the General Prosecutor’s Office. At first when he came, it took time to adjust, acclimatize, understand and so on. That there are many files, that they are overloaded, that there are no capacities, but everyone had a legitimate – justified expectation: progress on resonance files. On the main cases, people should understand that big thieves cannot sleep peacefully, if the Prosecutor’s Office does his job, said Igor Grosu.

Instead, in addition to apologies and justifications, Igor Grosu saw thieves released from prison and important cases classified.

I have not seen progress. I saw thieves, on which the criminal cases were closed. I saw how on individuals from the Parliament, the Prosecutor’s Office came and said that we have to lift the immunity on about 4 or 6 MPs, after which no measures were taken. Yes, they keep on telling me that the judges are to blame, but it is the prosecutors who are responsible for the quality of the evidence.

We will have a very serious evaluation of the performance and we will modify the law of the Prosecutor’s Office to allow us legally to evaluate the performance of the prosecutors, their assets, what cases they have investigated, etc. It must be a good sign for good prosecutors because good prosecutors and judges in the system are, so they need to be identified, created conditions for them. Asked what he would do with the Prosecutor General, Grosu hinted that his chair could shake. No one is intangible in this country, believe me.

Nobody called them there for life, so we’re going to have a serious discussion. All those who led institutions that had to fight corruption, concluded Igor Grosu.

We remind that previously, Teodor Cîrnat spoke about the fact that Alexandr Stoianoglo could be revoked from the position of head of the General Prosecutor’s Office, and this would be possible by a Decision of the Constitutional Court.

It may be that in the near future, Mr. Stoianoglo, as Prosecutor General, will be removed from office by a decision of the Constitutional Court, as this Decision is similar to the Judgment of the CC of 21 May 2020 which stated that the Prosecutor General was appointed by an unconstitutional law, but paragraph 83 stated that this did not affect the procedure for the appointment of the current Prosecutor General. Today the Court invigorated its jurisprudence and said: Even if these 4 members of the SCM were appointed a year ago and the principle of immovability is applied to them, in order to guarantee the supremacy of the constitution, we revoke them from office, but the decisions adopted with the presence of these 4 members of the SCM are legal until today, previously declared Cârnaț.

The lawyer said that the situation is similar, so the Constitutional Court opened the Pandora’s Box.

I believe that the President of the Republic of Moldova should submit tomorrow a complaint to the Constitutional Court requesting the declaration of unconstitutionality of the decree of former President Dodon by which he appointed Prosecutor General, Alexandr Stoianoglo, because he was appointed by law unconstitutional. There are two similar things, and the Constitutional Court today opened the Pandora’s Box, Cîrnaț pointed out.

We remind you that, on May 21, 2020, the Constitutional Court examined the complaint filed last year by several members of the Parliament.

The judges concluded that the contest by which Alexandr Stoianoglo was elected as Prosecutor General is unconstitutional.

However, the judges stressed that Alexandr Stoianoglo cannot be dismissed for this reason. On July 11, 2021, early parliamentary elections took place in the Republic of Moldova. They were won by PAS, which gained almost 53% of the vote and 63 seats in Parliament.

It should be noted that previously, PAS criticized the activity of the General Prosecutor, Alexandr Stoianoglo, after the latter had not registered progress in the social important cases, and the suspicion hovers that he would have favored the party until recently in government.
