Today, January 27, the Court of Appeal will examine the prosecutors’ appeal in the case of the suspended head of the Anticorruption Prosecutor’s Office, Viorel Morari. The Court of Appeal will examine the PCCOCS request after last week, the magistrates of the Chisinau Court, based in Ciocana, rejected the PCCOCS prosecutors’ request to apply the preventive measure – pre-trial detention for 30 days. The meeting will take place at 13:00.

SafeNews.md states that on January 19, Viorel Morari was detained for 72 hours by PCCOCS officers.

The next day, without his lawyers knowing, he was brought before the court, and prosecutors asked for an arrest warrant in his name for 30 days. The prosecutors’ request, however, was completely rejected as unfounded, and this was because the state prosecutors did not present enough evidence to present the accusation.

Viorel Morari is suspected of forgery in documents, illegal detention of a person, excess of power and knowingly prosecuting an innocent person. The General Prosecutor’s Office states that all these actions were committed against the co-owners of the “VENTO” gas stations.

Subsequently, on January 25, during a press conference, the suspended head of the PA rejected the accusations as serious and unfounded. He stated that he did not intend to evade law enforcement, but would bear all the illegalities committed by the General Prosecutor’s Office against him.

In a post on his Facebook page, the President of the Center for Legal Resources of Moldova, Vladislav Gribincea stated that the motivation for detaining the suspended head of the Anticorruption Prosecutor’s Office, Viorel Morari, is not plausible, and the only reason for requesting pre-trial detention is to “shut his critical mouth.” Moreover, the lawyer wanted to remind the fact that the general prosecutor, Alexandr Stoianoglo, previously declared that “the prosecutors will not arrest abusively”, and shortly after, Morari was detained.

“There is neither the risk of evasion (if he wanted to, Morari had been fleeing the country for a long time), nor of influencing the criminal investigation or committing other similar crimes (Morari no longer works as a prosecutor, being suspended from office for more than 12 months). The prosecutor’s argument (that Morari may flee to the Transnistrian region) confirms once again that there are no grounds for arrest. The ECHR has already found that such an argument is not acceptable (see ECtHR Ignatenco v. Moldova, para. 83), says the president of the Center for Legal Resources in Moldova.

Regarding the accusations brought against the suspended head of the Anticorruption Prosecutor’s Office, Vladislav Gribincea claims that they are “hallucinatory”.

On January 10, 2020, Viorel Morari was detained in another criminal case, initiated for “abuse of office” and “forgery”, after the Attorney General, Alexandr Stoianoglo, ordered the performance of checks within the specialized Anti Corruption Prosecutor’s Office.

Prior to that, in December 2019, Morari was removed from office and assumed that this action comes after he made a request to the tax authorities, which aimed at the file of external financing of the Socialist Party. At the time, Morari harshly criticized the new prosecutor general and anticipated his January 10, 2020 detention. Morari said at the time that prosecutor Stoianoglo’s actions against him would be based on his decision to restart investigations into the case of Russian funding of PSRM (controlled by then-pro-Russian President Igor Dodon), but also a new investigation targeting the MP from the current Parliament, about which he avoided giving details.

Also last year (2020) Viorel Morari said that the files in which he is accused appeared because he opposed the system. At the same time, the suspended head of the Anticorruption Prosecutor’s Office said that he was detained at the political command of President Igor Dodon.

Recently, during a press briefing, Morari presented several documents, but also data from which it appears that two Ukrainian companies, which belong directly or through Veaceslav Platon, have de facto as final beneficiary a name exactly like that of his wife. of Stoianoglo – Kurdova Țvetana.

The National Integrity Authority announced that it will analyze the information reported by the former prosecutor, Viorel Morari.
